Appendix B Edward Via College of Osteopathic Medicine Educational Aid Agreement This Employee Educational Aid Agreement ("Agreement") is entered into as of the date of the signature of the President, by and between the Edward Via College of Osteopathic Medicine (“Employer”) and ________________________________________________________________________________ (“Employee”). WHEREAS , the Employer desires to encourage and assist the Employee in furthering their education to enhance their job performance and contribution to the mission of VCOM; and WHEREAS , the Employee has expressed interest in pursuing an educational program and has requested financial assistance from the Employer for this purpose; and NOW, THEREFORE , in consideration of the mutual covenants and promises contained herein, and intending to be legally bound, the parties agree as follows: A. The Employer agrees to reimburse the Employee for tuition and required course-related fees for approved educational courses listed on the Educational Aid Application attached hereto, and in accordance with the Employee Educational Aid Policy and terms and conditions in this Educational Aid Agreement. • Sum to be Reimbursed Under This Agreement: _______________ • Total Sum to be Reimbursed Under All Approved Agreements to Date: _______________ B. In consideration of reimbursement for coursework completed at the higher education institution listed herein, the Employee agrees to remain continually employed at VCOM for a period of ____________ years following completion of the last course for which they received reimbursement. • If the Employee does not remain employed at VCOM for any portion of the required period as defined herein, the Employee will repay VCOM on the day employment is terminated, the full amount of tuition and fee reimbursements received. Should additional Educational Aid Applications and Agreements be submitted and approved, the full amount to be repaid to VCOM will be based on the sum of all Agreements; or • If the Employee remains employed for a portion of the required period, the Employee will repay VCOM, on the day employment is terminated, the pro-rata amount of the tuition and fee reimbursements received as set out in the Educational Aid Program Policy. Should additional Educational Aid Applications and Agreements be submitted and approved, the pro-rata amount to be repaid to VCOM will be based on the sum of all Agreements. o Based on the agreed upon service period under B above, the pro-rata calculation will be : _______________ C. Homestead and all other exemptions, presentations, demand, protest and notice of dishonor are hereby waived by the undersigned. D. The Employee must list all courses for which they are seeking reimbursement and receive approval of the Educational Aid Agreement a minimum of three months prior to beginning coursework. The Employee will not be reimbursed for any classes taken that were not approved prior to matriculation. E. The Employee must achieve a course grade of B- or higher for approved courses to qualify for reimbursement. F. Within 30 days of completion of each course, the Employee must submit an unofficial transcript documenting the course completed and the grade earned and receipt(s) for the payment of tuition and required course-related fees from the college or university at which they completed the courses to receive reimbursement from VCOM for these courses. G. The Employer may not approve future requests for educational aid if the Employee is not making satisfactory progress in prior course(s) for which the Employer has reimbursed the Employee or in their program of study. H. The Employee must submit a Supplemental Application for consideration of reimbursement if they intend to seek reimbursement for additional courses not on the Initial Application, a minimum of three months prior to beginning coursework.
