2.2.4 Review by the Campus Dean Upon request of the student for his/her case to be heard solely by the Campus Dean, and if the Campus Dean is willing to hear the case, the Campus Dean will determine if a violation has occurred and will determine the action to be taken (if any) within 14 calendar days of the review. In reviewing the case, the Campus Dean will not only consider the current case but will also consider any previous violations that have occurred, which includes any existing behavioral probationary status. The alleged offender will be notified of the decision, in writing, within 14 calendar days. Upon receipt of the letter the student should make an appointment to meet with the Campus Dean to discuss the terms of the decision. The meeting between the student and Campus Dean must occur within seven (7) calendar days of the Campus Dean’s decision being sent. The Campus Dean may request the student to come to campus to receive the letter in advance of mailing. 2.2.5 Appeal Process Upon receiving written notification from the Campus Dean, the student, within seven (7) calendar days, may appeal the Campus Dean’s decision to the Provost. The Provost has discretionary power to affirm, modify, or remand the decision. The appeal must be in writing and be based upon new, relevant, and material information that was not available to the Campus Dean. After receiving the written appeal, the Provost will consider the request and will notify the student, in writing, of his/her decision generally within 14 calendar days of receiving the written appeal. However, the decision may take 30 days or longer depending upon the investigation of the case. The Provost reserves the right to obtain outside legal opinions on the review and the decisions that have been made, and to delay decision until such time that Counsel has responded. The decision of the Provost is final. 3. DURATION OF POLICY The Professional and Ethical Standards Board Policy is effective as of the date above and shall remain effective until amended or terminated by the President and Provost.
